In this News section, we aim to let you know of recent developments, as well as examples of the types of matters we cover. This is by no means a comprehensive assignment list. Instead, the jobs noted are purely to give you a sense of the matters we have been entrusted to cover. Accordingly, our Testimonials section includes testimonials for matters not shown below.
The World Bank: ICSID Arbitration
Lloyd Michaux was recently selected by The World Bank to provide realtime and daily court reporting services for a hearing held at the Hong Kong International Arbitration Centre (HKIAC).

Ken Fleming - Director of Business Development: "We are extremely pleased to have been selected. The World Bank looked at all the court reporting firms based in Hong Kong and their selection process was much more exhaustive than normal. It included several internal reviews as well as their in-house legal team speaking with a number of referees to verify our suitability.

As such, our appointment brings with it significant credibility and recognition in terms of the relative quality of our arbitration court reporting service and reflects our growing reputation. Lloyd Michaux is now proudly listed by The World Bank as a preferred realtime and daily court reporting services provider in this region."

The panel of arbitrators were: Neil Kaplan QC, John Beechey - ICC Chairman, and Toby Landau QC. We worked with teams from Freshfields Bruckhaus Deringer - Paris office and McMillan Keck of New York.
HKIAC Arbitration: Herbert Smith
We are pleased to welcome Herbert Smith as a client. Herbert Smith selected Lloyd Michaux to provide realtime and daily court reporting services for an HKIAC administered arbitration involving one of their premier investment bank clients.

Ken Fleming - Director of Business Development: "Prior to this we had not worked with Herbert Smith. This was an important matter involving one of their premier clients. In order to gain selection, we were required to not only provide testimonials, but also make a presentation to their client's in-house legal team.

We feel our selection - ahead of the incumbent court reporting firm - was a pretty big vote of confidence from Herbert Smith and their client. Herbert Smith told me they were very happy with our service and we look forward to working with them again."
Atmel Corporation v. NEL Group Ltd, et al: K&L Gates
We are also pleased to welcome K&L Gates as a deposition services client. We were engaged by K&L Gates to cover a series of depositions in Hong Kong and Malaysia. Realtime, cleaned-up daily drafts and video were provided as standard in addition to the normal final deliverables.

We look forward to growing our existing relationships, as well as welcoming new clients."
TSMC v SMIC: Wilson Sonsini Goodrich & Rosati (WSGR)
This was one of the region's most high-profile hi-tech matters, between the world's largest (TSMC) and third largest (SMIC) semiconductor foundries. Lloyd Michaux was retained exclusively by WSGR to cover all of their Asia depositions.

We ended up covering upwards of 60 days of depositions. On a number of occasions, this required the triple tracking of reporters. The terminology was very technical in nature. Realtime reporting, as well as daily cleaned-up drafts, were provided to both sides on all depositions. We also provided E-Transcripts, hard copy transcripts, hyperlinked electronic transcripts and video as standard to both sides.

The lead partner, David Steuer, was kind enough to provide a testimonial.
Akai v Ernst & Young
Akai is Hong Kong's biggest ever corporate collapse and the liquidators were suing Ernst & Young for negligence. The case was bitterly contested and was 10 years in coming to court. When it did, the liquidators were seeking US$1 billion from Ernst & Young. The case was scheduled to run for six/seven months in the Hong Kong High Court - by far the largest court case in Hong Kong and the region for many years.

This matter was extremely high-profile, being widely reported in both the local and international media. We are very proud to have been selected by the parties to cover this matter.

There have been very few of these public hearings held to date, and Lloyd Michaux was proud to be selected by the parties to cover this matter.
